Terms of Use and Licence Agreement (EULA)
As of October 13, 2026
1. Scope and provider
- These terms govern the use of the LitArbi software — the apps for macOS and Windows including the Word integration, the apps for iPad and Android tablets, and the LitArbi Server — and of the websites litarbi.app and moot.litarbi.app. The provider is Game Ban Appeal UG (haftungsbeschränkt), Mittelstraße 11, 40789 Monheim am Rhein, Germany ("we").
- These terms are also the end-user licence agreement (EULA) for the software. They cover LitArbi for Word (in Word for Mac and Windows, Word on the web and Word for iPad), LitArbi for LibreOffice (in LibreOffice Writer on the Mac and on Windows) and LitArbi for Google Docs, and they apply however you obtain the software: from our websites, from Apple's App Store, from Google Play, from Microsoft AppSource or from the Google Workspace Marketplace.
- They apply to free licences (the test programme, season licences for moot court teams) and to paid licences alike. For Enterprise firm-wide licences, the provisions of the respective agreement take precedence.
- Conflicting terms of the user apply only if we expressly agree to them in text form.
2. Purchase through Paddle
- Paid licences are sold by our online reseller Paddle.com Market Limited ("Paddle"), the merchant of record for all orders. The purchase — payment, invoicing, VAT and any right of withdrawal — is governed by Paddle's buyer terms. These terms govern the use of the software between you and us.
- Prices and the scope of each plan are those on the pricing page at the time of the order. In addition to your statutory rights, our voluntary 14-day money-back guarantee applies.
3. Test programme (beta)
- The apps for macOS and Windows are in beta. Participation is free of charge and serves to test the software. A beta licence runs until the end of the test programme or until the date stated when it was issued.
- There is no entitlement to participation, availability, particular features or freedom from defects. We may modify, suspend or end the test programme and revoke beta licences at any time.
- Test software can contain bugs. Work on copies of your documents and back up your data regularly (e.g. via "Export Matter").
4. Licence and scope of use
- With the licence key we grant you, for the term of the licence, a simple, non-transferable and
non-sublicensable right to use LitArbi within the scope of your licence:
- Solo: one lawyer on up to two computers (Mac or Windows).
- Firm: up to two computers per licensed lawyer. The firm decides who uses the licences and may reassign them.
- LitArbi Server: operating one server on the firm's hosting for the licensed number of server users (lawyers and staff with their own account). Guests invited to single matters need no licence. Every lawyer also needs a Solo or Firm licence.
- LitArbi for iPad & Android: an add-on to a licence; up to two tablets per licensed lawyer. A free trial on a tablet is limited to one per email address.
- Moot court season licence: for the named team, the moot matters of the named competition and the number of computers applied for, until the end of the season — for taking part in the competition, not for professional practice.
- Beta licence: one person on up to two computers, for testing.
- LitArbi for Word and LitArbi for Google Docs: free of charge, for citing from a bundle made with LitArbi or from a LitArbi Server you have access to. Functions of the LitArbi apps — such as numbering, the index of authorities and Prepare for Filing — need the licence of the respective app.
- LitArbi for LibreOffice: free of charge, for citing in LibreOffice Writer from LitArbi on the same computer or from a LitArbi Server you have access to. Numbering exhibits and Update Exhibits work with LitArbi on the same computer and need its licence.
- Licence keys are confidential and must not be shared with anyone outside the licence. You can release a computer or tablet in the app to use its place for another device.
- To check the licence, LitArbi occasionally connects to our licence service (see the privacy policy); without a connection the app keeps working for a transition period.
- Decompilation and reverse engineering are prohibited except to the extent mandatorily permitted by Sections 69d, 69e of the German Copyright Act. Do not circumvent the licence check.
5. Hosted LitArbi Server
- Once we offer it, we can host a LitArbi Server for your firm or team. Size, address and price follow from the order; the hosting is a separate add-on to the server licence.
- We run the hosting in data centres in the EU, keep it up to date and back it up. The content of your matters stays under your firm's control; we access it only as far as operation, security or support at your request require it, and keep confidential whatever we learn in doing so. We bind our subcontractors to the same confidentiality.
- Before the hosting starts, we conclude a data processing agreement under Art. 28 GDPR with you that names our subprocessors; for law firms in Germany it includes the confidentiality obligation under Section 43e of the Federal Lawyers' Act (BRAO).
- When the hosting ends, you can export your matters for 30 days; after that we delete the server and its data, and backups at the end of their retention period.
6. Apps from app stores and marketplaces
- If you obtain LitArbi from Apple's App Store, Google Play, Microsoft AppSource or the Google Workspace Marketplace, this agreement is concluded between you and us only — not with Apple, Google or Microsoft (the "store operator"). We alone, not the store operator, are responsible for the software and its content. The store operator's terms of use apply in addition.
- For apps from Apple's App Store, the following also applies:
- The licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions; other accounts associated with the purchaser via Family Sharing or volume purchasing may also use the app. The limits of section 4 apply in addition.
- Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app. We provide support at litarbi.app/support.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, within the limits of section 13.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- When using the app, you must comply with applicable third-party terms, such as your mobile data contract.
- Questions, complaints or claims regarding the app go to the provider named in section 1: hello@litarbi.app or litarbi.app/support.
- Apple and Apple's subsidiaries are third-party beneficiaries of this agreement; upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
7. Term, renewal and cancellation
- Paid licences are subscriptions with a monthly or yearly term. Each renews for the same term unless cancelled before it ends.
- You can cancel at any time, effective at the end of the paid period — with the link in Paddle's payment confirmation, at paddle.net or by email to hello@litarbi.app. The licence stays active until then.
- If prices change, new prices apply to a running subscription only from its next renewal, and only if we told you by email at least 30 days in advance; you may cancel before the renewal.
- Free licences end with the test programme, on the stated date or at the end of the season.
- Either side's right to terminate for good cause remains unaffected — for us in particular if a licence key is shared or the licence check is circumvented.
8. When a licence ends
When a licence ends, the right of use lapses. Your work product — matters, bundles, submissions and exports — remains yours and stays unchanged on your computers or your firm's server; a new licence opens it again.
9. System requirements
LitArbi runs on macOS 14 or later and on Windows 10 (version 1809 or later) or 11, with Microsoft Word; the tablet apps on iPadOS 16 or Android 13 or later; the LitArbi Server on the firm's web hosting. The current requirements are on the Platforms and LitArbi Server pages. Licences for Microsoft Word and other third-party software are not included.
10. AI functions and third-party services
AI functions are optional and run only when you start them, with your own account at the provider you choose. That account is governed by the provider's terms. Results of AI functions, text recognition and translation can contain errors; check them before any use. LitArbi for Word and LitArbi for Google Docs run inside Microsoft Word and Google Docs; these programs and your Microsoft or Google account are governed by Microsoft's and Google's terms. LitArbi for LibreOffice runs inside LibreOffice, which is governed by its own licence.
11. Your data, your responsibility
LitArbi processes your documents on your computers or on your firm's server (see the privacy policy). You remain responsible for compliance with your professional duties (e.g. confidentiality, review of submissions before filing), with the rules of a moot court competition, and for running and backing up your own LitArbi Server. LitArbi is a tool and does not provide legal advice.
12. Feedback
If you send us feedback, bug reports or suggestions, we may use them to improve the software without restriction in time or territory.
13. Warranty and liability
- Free licences (test programme, moot court season licences): we are liable only for intent and gross negligence and for fraudulently concealed defects.
- Paid licences: the statutory warranty rights apply. We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for breach of an essential contractual obligation — one whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely — limited to the damage typical for the contract and foreseeable. Strict liability for defects already present when the contract is concluded (Section 536a(1), first alternative, German Civil Code) is excluded.
- Liability for injury to life, body or health, under the German Product Liability Act and under a guarantee given remains unaffected.
- For loss of data we are otherwise liable only up to the effort that would have been required for recovery had proper, regular backups been made.
14. Changes to these terms
We may change these terms for the future, for example when new features or plans are added. For a running subscription, changed terms apply only from its next renewal, and only if we told you by email at least 30 days in advance; you may cancel before then.
15. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside.
- If the user is a merchant, a legal entity under public law or a special fund under public law, the courts at the company's seat have jurisdiction.
- Should individual provisions be invalid, the remaining provisions remain unaffected.
